Who we are

MaxOut is a workout tracking app developed and operated by OSC Limitada, based in Talca, Chile. By creating an account or using the app you accept these terms and our privacy policy. If you do not agree with them, please do not use it.

Your account

  • You need an account to use MaxOut, and you must be at least 13 years old to create one. If you are under 18, you need the authorization of your parent or guardian.
  • The information you give us when you register must be true, and the account is personal.
  • You are responsible for keeping your password confidential and for what is done with your account. If you believe someone else has access to it, write to us.
  • You can delete your account whenever you want, from Settings → Account → Delete account.

MaxOut is not medical advice

MaxOut is a tool for logging and organizing your training. The routines, suggested programs, exercise instructions, tips and calculations —such as the estimated 1RM or the plate calculator— are for guidance only and do not replace an assessment by a doctor, physical therapist or qualified trainer.

Consult a healthcare professional before starting an exercise program, especially if you have an injury or a medical condition. You train at your own risk: stop if you feel pain, dizziness or shortness of breath.

Coins, experience and game items

Experience, coins, items, bags and achievements are part of the game within the app. They are earned by training, cannot be bought with real money and have no monetary value: they cannot be exchanged for money, sold, transferred to another account or claimed outside the app.

We may adjust or correct game progress when it was obtained through an app error or by breaching these terms, and change the shop catalog or the rules of the game. Deleting your account forfeits all the progress associated with it.

MaxOut Premium

MaxOut can be used for free. MaxOut Premium is an optional subscription that adds features, such as longer periods and additional analysis in your stats, more coins for training, one streak freeze per month and exclusive items in the shop. What each plan includes, its limits and its price are shown in the app before you buy.

  • It is purchased within the app, for one month or one year, and paid for through Google Play with the Google account on your phone. The price is shown in your country's currency before you confirm the purchase.
  • The subscription renews automatically at the end of each period, for the same term and at the current price, until you cancel it. Google Play charges each renewal.
  • You can cancel it whenever you want from Google Play (Payments & subscriptions → Subscriptions), or from the app with "Manage subscription", which opens that same page. Cancelling stops future renewals and you keep Premium until the end of the period already paid for. Uninstalling the app does not cancel the subscription.
  • Charges and refunds are handled by Google Play under its policies, without prejudice to your rights under Law No. 19.496. If the price changes, Google Play will notify you before charging the new one, according to its rules.
  • Deleting your account cancels the subscription, so there will be no new charges. The period already paid for is not automatically refunded.

When the subscription ends you keep your history, your coins and the items you bought. You lose access to Premium features, and Premium-exclusive items cannot be equipped until you subscribe again.

Your data and your content

Your training history, routines, custom exercises and profile photo are yours. You authorize us to store, sync and process them only to the extent necessary to provide the service to you, as described in the privacy policy. You can export or delete them whenever you want.

If you turn on "Help match imported exercises", you authorize us to use, free of charge and anonymously, the exercise name matches you share, in order to suggest them to other people importing from the same app.

Your profile photo and the names you choose must not be unlawful or offensive, or infringe the rights of third parties.

Acceptable use

By using MaxOut you agree not to:

  • Manipulate game progress by means other than normal use of the app, such as altering local data or requests to the server.
  • Access our servers in an automated way or by routes other than the app, attempt to access other people's accounts or data, or interfere with the operation of the service.
  • Decompile, modify or redistribute the app, except as expressly permitted by law.

If you breach these terms we may suspend or close your account. Except in serious cases or where the law requires otherwise, we will notify you first at the email you registered with.

Intellectual property

The app, its name, logo, design and code belong to OSC Limitada. We grant you a personal, free, non-exclusive and non-transferable license to use it on your devices in accordance with these terms.

Some content comes from third parties under their own licenses: the exercise catalog is based on Free Exercise DB, which is in the public domain, and some sounds are used under a Creative Commons license, with the attribution shown in Settings.

Service availability

MaxOut keeps your training on your phone and works offline, but signing in, syncing and browsing the shop or programs require a connection to our servers. We strive to keep them available at all times, but we do not guarantee that the service will be uninterrupted or error-free. We recommend exporting a backup from time to time.

We may modify, add or remove features of the app. If we decide to shut down the service, we will announce it at least 30 days in advance, so that you can export your data.

Liability

To the extent permitted by law, OSC Limitada is not liable for injury or harm resulting from exercise, nor for loss of data or indirect damages arising from the use of the app or the inability to use it. Nothing in the foregoing limits the rights that Law No. 19.496 on the Protection of Consumer Rights grants you and that cannot be waived.

Governing law

These terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the ordinary courts of justice of Talca, without prejudice to your right to go to the courts of your place of residence or to the Servicio Nacional del Consumidor (Chile's National Consumer Service) as provided by law.

Changes to these terms

We may update these terms. The version in force is always the one published on this page, with the date of its last update. If the change is significant we will notify you at the email you registered with or within the app, and continuing to use it after that notice means you accept the new version.
